A DRIVER has avoided a ban because of the impact on family members.
Hayley Marie Agnew, 30, of Alder Road, Coxford, Southampton, was clocked driving a 61-reg Vauxhall eastbound on the M27 between junctions 4-5 near Eastleigh on March 6.
Magistrates in Basingstoke were told her average speed was 65mph in a 50-zone, imposed to allow safe working on the Smart Motorway scheme.
The conviction put Agnew over the threshold for a ban but magistrates spared her the disqualification because of the impact on her grandmother and children. No further details were given.
She was fined £66 with a £32 victim surcharge, £85 costs and three penalty points on her licence.
A charge of failing to tell police the identity of the driver believed to have committed an offence was withdrawn.
