INITIAL DEMOLITION NOTICE WADE UNDER SECTION 138A AND SCHEDULE 5A H00SIN6 ACT 1985 AS AMENDED
Notice is hereby given by Winchester City Council, City Offices, Colebrook Street, Winchester, Hampshire S023 9LJ ("the Council").
It is the intention of the Council to demolish and make substantial changes to the following two Properties which are a pair of semidetached houses ("the Property").
57 S 59 Binary Hill Simmon Winchester Hampshire S022 4DD
The demolition and alteration of the Property is required to facilitate a new homes development at The Valley, Stanmore as part of the Councils New Homes Delivery Program. The Council intends to build 76 new homes on site and the Property forms part of this development.
The Council intends to demolish the Property before 31 st December 2024
This notice comes into effect on the date it is served.
This notice will remain in force up to and including 31st as above December 2024 unless revoked or otherwise terminated by virtue of paragraph 3 of Schedule 5A Housing Act 1985.
While this notice remains in force Winchester City Council will not be under any obligation to make such a grant as mentioned in section 138 (1) of the Housing Act 1985 in respect of any claim made by the tenant to exercise the right to buy in respect of the Property.
The Notice does not prevent the making of a claim under the right to buy or the taking of any steps in relation to the claim up to the point where section 138(1) would otherwise operate in relation to the claim or the operation of that provision in most circumstances where the notice ceases to be in force, but if the Council subsequently serves a final demolition notice in respect of the Property, the right to buy will not arise in respect of it while that notice is in force and any existing claim will cease to be effective.
There may be a right under Section 138C to compensation in respect of certain expenditure incurred in relation to an existing right to buy claim that was established prior to the service of this notice. Any claim for compensation must be served on the Council within three months from the date this notice was served. A claim for compensation can be made for any reasonable expenses incurred by the tenant in connection with the exercise of the claim of the right to buy in respect of legal and other fees and other professional costs and expenses incurred prior to the demolition notice coming into force.
