Sam Worthington has reportedly settled the assault case against him.

The Avatar star had been arraigned in New York on counts including misdemeanour assault after allegedly having a scuffle with a photographer, who was also charged in their encounter.

However, Sam's lawyer has now taken a conditional dismissal deal on his behalf, reported the New York Daily News.

The 37-year-old star wasn't present at Manhattan Criminal Court when his lawyer took the non-jail deal on his behalf last month.

Sam submitted a waiver to the court explaining that he was "contractually committed in Europe at this time" and thanked the judge and prosecutors for working with his schedule.

The star said in a signed statement: "I understand that as long as I continue to lead a law abiding life, this matter will be dismissed and sealed."

The case was settled quietly in April after being brought forward a month.
